New Right to Manage Regulations Will Apply from October
New Right to Manage regulations for local authority tenants will come into force this October. The new regulations aim to simplify the Right to Manage process, making it a more attractive option for tenants groups.
The key changes will be
§ Only one ballot of tenants will be required, rather than the two that is required at the moment
§ The ballot will take place when it is known what responsibilities the TMO wishes take on; the budgets for each of these responsibilities; the proposed membership and governance arrangements of the TMO.
§ The ballot requirements will that a majority of those voting must vote yes. (Not a majority of all tenants on the estate as required by the final ballot under the current regulations)
§ Developing TMOs will have a wider choice when appointing advisors (The current requirement that they be appointed from a list of government Approved Agencies is to be scrapped).
§ The competence of developing TMOs will be evaluated by an external Approved Assessor. (Replacing the current arrangement where the TMO’s advisor / training agency certifies competence).
