New Tenant Control Opportunities – Links to Resources
From October 1st 2008 new rules took effect following a government review of the Right to Manage and the wider framework for the development of TMOs in this country.
Key features of the new arrangements are:
· There will be one main ballot of tenants before a TMO can be set up, with ballot rules in line with other tenant ballots on changes to management and ownership arrangements.
· The competence of a new TMO will be assessed by an independent Approved Assessor, not by the organisation that has been providing training and advice to the group.
· Residents groups will have a wider choice of advisors and trainers when exploring tenant control options and developing a TMO.
· There will be voluntary route to tenant management, avoiding the need for a Right to Manage Notice in places where the landlord is supporting the proposed TMO
· There will be the possibility of grant support for Housing Association tenants that are interested in managing their homes.
· Tenant’s groups that want some limited responsibility, for example over the gardening or cleaning services, will have a simpler and quicker option called a Local Management Agreement.

New Guidance called 'Residents Choice' providing information about the options and opportunities and advice about how options can be explored and how to take forward the preferred approach.
New Statutory Guidance called 'Local Choice, Local Control' which sets out some ‘must dos’ for landlords, advisors and tenants groups who are involved in initiatives covered by the new Right to Manage Regulations applying after October 1st 2008.
The ‘Common Assessment Model’ which sets out the standards of competence required before a tenants group can go ahead with a full ballot of tenants on a proposal for management by a TMO.
It is called a Common Assessment Model because it is a tool used by the independent Approved Assessors but can also be used by tenants groups and advisors to do their own ‘self assessment’ of competence levels and training needs. NOTE THAT THE MODEL WAS UPDATED on October 28 2008. It comes in four files:
